Inventive step can be one of the less black and white areas of objection to be satisfied for a patent to be granted. In this webinar, we take a look at both European and Japanese practice, with a deep dive into the tests applied, and how to formulate arguments with the best chance of success. We will focus on a practical application of law and case law, selecting the closest prior art, evidence to prove technical effect, and more.
We shall also look at inventive step as part of the opposition processes, in terms of practical pointers for defending or attacking patents.
Finally, we shall look at some example scenarios, and talk through how we would deal with them to put our best arguments forward, ensuring inventive step remains objective, not subjective.
