CJA Panel Training: Profiling, Bolstering, Vouching, and More: Winnable Trial Objections to Prosecutorial Misconduct
This presentation will assist federal criminal defense practitioners with identifying various types of prosecutorial misconduct at trial. Drawing from recent cases, the presentation will cover frequently recurring issues, including misusing experts or agents to elicit profile testimony, abusing the nonhearsay purpose of “explaining the investigation,” improperly commenting on the accused’s right to silence, bolstering a witness’s credibility, and vouching for the credibility of the prosecution itself. The presentation will also address hurdles that practitioners may face on appeal
