Crim-Imm 101: Understanding Immigration Status for Defense Attorneys

Description

In 2010 the Supreme Court decided Padilla v. Kentucky, holding the 6th Amendment requires criminal defense counsel to advise non-citizen clients about the immigration consequences that could arise from the decision to plead guilty or go to trial. Since Padilla was decided, it has become more necessary than ever for defense attorneys to advise immigrant clients about not only immigration consequences of criminal convictions, but also the risk of Immigration and Customs Enforcement (“ICE”) arrest in the middle of a criminal case. Regional Immigration Assistance Centers throughout New York State work with defense counsel to fulfill their obligation under Padilla. This training is aimed to help defense attorneys learn the necessary information to gather from clients to work with immigration counsel.

Genia leads IDP’s Community Defense team, which creates Know Your Rights materials and other resources on interactions with ICE. She also leads IDP’s ICE raids monitoring team, which keeps track of and shares trends and tactics of ICE community arrests. Genia came to IDP from the immigration practice at The Bronx Defenders, where she worked with attorneys on minimizing the immigration impact for non-citizens of contact with the criminal and child welfare systems and represented non-citizens in affirmative and defensive proceedings. Genia received her law degree from Northeastern University School of Law and her undergraduate degree from Hampshire College. Jorge Guerreiro (Staff Attorney @Immigrant Defense Project) Jorge comes to IDP from the Bronx Defenders (BXD) where he advised attorneys in criminal and family court on immigration consequences for clients in those contexts. He also provided assistance to clients in affirmative applications, and in non-detained removal defense. He joins IDP as part of IDP’s Padilla Support Center where he advises attorneys on the immigration consequences of criminal cases. Jorge is originally from Los Angeles. He received his law degree from the University of California Los Angeles and his undergraduate degree from the University of Southern California.
