Access to Medication Assisted Treatment in Jails and Prisons Part 2: Eighth Amendment and Legal Considerations

On January 14, 2021, the U.S. Department of Justice, Civil Rights Division and the U.S. Attorney’s Office for the District of New Jersey announced the results of an investigation of the Cumberland County Jail. The investigation looked at potential violations of the Eighth and 14th Amendments of the Constitution due to failure to screen for or provide adequate treatment to individuals at risk of self-harm and suicide.
This webinar will look at the findings of this investigation, specifically in reference to withdrawal management and medications for opioid use disorder. Two of the attorneys representing the government in this investigation, the Assistant US Attorney from the District of New Jersey and Trial Attorney from the DOJ Civil Rights Division will present on this case and recent developments in Eighth Amendment legal action. This is part 2 of a webinar series looking at access to medication assisted treatment in jails and prisons. Part 1 was recorded in August 2022 available at www.rsat-tta.com.
Learning Objectives
After completing this webinar, participants will be able to:
• Understand the connection between unmanaged withdrawal and suicide, especially in jail settings.
• Identify at least two ways the Eighth Amendment protects the rights of individuals with opioid use disorder.
• Learn what civil rights violations can be reported under the Eighth and 14th Amendments.

As the Civil Rights Chief, Mr. Campion supervises the civil rights enforcement matters at the U.S. Attorney’s Office. In that role, he guides civil rights investigations, and where appropriate, brings civil actions in U.S. District Court to enforce the federal civil rights laws. Mr. Campion received a Bachelor of Arts degree in 1994 from New York University. He received a Juris Doctorate in 1999 from Fordham University School of Law. Since 2007, he has served as an Assistant U.S. Attorney in the District of New Jersey, serving as the Civil Rights Coordinator of the Civil Division from 2013 to 2016, the Chief of the Civil Division’s Civil Rights Unit from 2016 to 2022, and the Chief of the Civil Rights Division since 2022. Curtis Harris (Trial Attorney, Special Litigation Section @Department of Justice, Civil Rights Division) Curtis Harris is a Trial Attorney for the Special Litigation Section of the Department of Justice Civil Rights Division. As a Trial Attorney, Mr. Harris has pursued civil rights matters under the Civil Rights of Institutionalized Persons Act (CRIPA). In that role, he investigates potential violations of CRIPA, enforces settlement agreements and remedial orders, and where appropriate, brings civil actions in U.S. District Court. Mr. Harris received a Bachelor of Arts degree in 2015 from Hampton University. He received a Juris Doctorate in 2019 from University of California, Los Angeles School of Law. Before joining the Special Litigation Section, he worked as a litigation fellow for the ACLU National Prison Project. Andrew Klein, Ph.D. (Senior Scientist for Criminal Justice @Advocates for Human Potential) Andrew Klein, Ph.D., is a senior scientist for criminal justice at Advocates for Human Potential (AHP). His areas of expertise include criminal justice, court administration, institutional and community corrections, substance use disorder (SUD) treatment, domestic violence, medication-assisted treatment (MAT), and victim services. Since 2010, he has served as the project director for providing training and technical assistance for the U.S. Department of Justice (DOJ) Bureau of Justice Assistance prison and jail drug treatment initiative, the Residential Substance Abuse Treatment (RSAT) for State Prisoners Program. Dr. Klein received his Ph.D. in law, policy, and society from Northeastern University.
