Quarterly Law Seminar - A talk by Dr Kurt Xerri
'The Limits of State Intervention in the Private Rented Sector: Fifteen Years of ECHR and Constitutional Jurisprudence'.

Since 2006, the ECHR has assumed a greater supervisory role in the scrutiny of rent controls imposed by State Parties to the Convention. Malta was one of the States which were more critically affected by this new, broader interpretation of Article 1 Protocol 1 in the field of housing policy, and this has prompted responses from both the Maltese judicial and legislative organs. Despite numerous judgments and the enactment of two amending acts, there still remain open questions on the adequacy of the remedies afforded to Maltese applicants.

Dr Xerri is a resident lecturer within the Department of Civil Law, at the Faculty of Laws and serves as an advisor to the Housing Authority
