Recent Developments On Liquidated & Ascertained Damages

Description

Liquidated and ascertained damages (LADs) are predetermined damages based on certain formulas agreed between parties to a contract at the time such contract is concluded. Section 75 of the Contracts Act 1950 applies to LADs and penalties in contracts governed by Malaysian laws.

This webinar seeks to discuss the evolution of the law on the subject and how contract clauses have been drafted in response to decided cases.
